GENERAL PROVISIONS

1.1 These general conditions of sale (hereinafter, "General Conditions") apply to all sales of products (hereinafter, "Products" or "Product") purchased through the website www.impresaagricolacintrone.it (hereinafter " Site ").

1.2 The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter "Customers" or the "Customer"), understood as natural persons acting for purposes unrelated to their commercial, business or professionally carried out.

1.3 The language available to conclude the contract is Italian.

1.4 The Customer is required to carefully read the General Conditions that have been made available to him on the Site in a manner suitable for allowing the Customer to store and reproduce them.

1.5 The contracts concluded with Saponaro Agricola Srls (as identified below) through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 (hereinafter also the "Consumer Code"), by Legislative Decree 9 April 2003, n. 70 (hereinafter also the "E-commerce Decree") and, as applicable, by RD 16.03.1942, n. 262 (hereinafter also the "Civil Code).

PRICE

4.1 The prices of the products are inclusive of all taxes and duties except for duties and other charges that may be applied by the customs of the destination country.

4.2 All prices are expressed in Euros.

4.3 Shipping costs are charged to the customer, except for any promotions that can be consulted on the shipping costs page

ORDER OF PRODUCTS

5.1 The essential characteristics and prices of the Products are shown in the offer relating to each Product.

5.2 Orders that come from subjects who have not reached the age of majority will not be accepted.

5.3 To purchase the Products, the Customer must fill in the online order form and send to Azienda Agricola Cintrone in electronic format, only the data necessary for the delivery and eventual billing of an order will be requested.

5.4 The Customer must put the Product in the appropriate "cart", enter the personal data, enter the shipping data and, after having read the General Conditions, with particular reference to the contribution for delivery costs, to the procedures for exercising the right of withdrawal and the Privacy Policy and provided confirmation of having read it, must select the desired payment method and choose the "Confirm order" option.

5.5 Before submitting your purchase order, the Customer will have the opportunity to correct any data entry errors by following the appropriate modification procedure contained in the Site. In particular, the Customer has the right to change the quantity and type of Products who intends to purchase, adding or deleting one or more Products from the "cart".

5.6 By sending the order, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions.

5.7 Saponaro Agricola Srls reserves the right to evaluate the acceptance of orders received. Saponaro Agricola Srls will notify the Customer of any impossibility of accepting orders received within 30 days from the day following that on which the Customer has sent the order and will refund any sums already paid by the Customer for the payment of the supply.

5.8 No contract must be considered concluded between Saponaro Agricola Srls and the Customer if Saponaro Agricola Srls has reasonable grounds to believe that the Customer does not operate on the basis of an effective and genuine interest in purchasing the products ordered. In such cases, the order sent by the Customer must be deemed to have no effect whatsoever. Saponaro Agricola Srls will send the Customer, by e-mail, a communication certifying the failure to conclude the Contract, also taking care of the cancellation of any charge and / or expense charged to the Customer.

TERMS OF PAYMENT

6.1 The Customer may pay the price of the Products and the related delivery costs by credit card

6.2 Payments made by credit card are accepted

6.3 The transaction will be debited from the Client's linked account only after: a) the data have been verified (on a secure server directly from the Bank, Saponaro Agricola Srls will have no direct access to your data), b) the debit authorization by the company issuing the credit card used by the Customer and c) the availability of the Product has been confirmed by Saponaro Agricola Srls

6.4 In the event that, for any reason, the debit of the amounts due by the Customer proves impossible, the sales process is automatically canceled and the sale automatically canceled.

CONFIRMATION OF RECEIPT OF THE ORDER

7.1 Upon receipt of an order, Saponaro Agricola Srls will automatically send a confirmation of receipt by e-mail, in which all the details of an order itself, the essential characteristics of the ordered product, its price, the amount paid, the existence will be summarized. the right of withdrawal - with an indication of the times and methods for returning the goods - the geographical address to submit any complaints and information on the assistance services and existing commercial guarantees.

7.2 Following the receipt of an order Saponaro Agricola Srls will verify the availability of the ordered product and the existence of the other conditions for the sale and only after this verification will it communicate its acceptance of an order and the shipment of the product.

7.3 In the event that Saponaro Agricola Srls is unable to fulfill an order received, it will promptly notify the Customer.

7.4 Any right of the customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things caused by the non-acceptance of an order.

TRANSPORT AND DELIVERY

8.1 The Products purchased on the Site will be delivered to the address indicated by the Customer. In any case, the Customer has the right to request the delivery of the products to a natural person of his choice. No deliveries will be made to post office boxes.

8.2 For each order placed on the Site, Saponaro Agricola Srls will issue an invoice for the goods shipped, sending it together with the package or even by e-mail. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid. No change in the invoice will be possible after the issuance of the same.

8.3 The delivery costs of the goods are charged to the Customer and are clearly highlighted on the Site and in the order form.

8.4 All purchases will be delivered by express courier with which Saponaro Agricola Srls has entered into collaboration agreements (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. Saponaro Agricola Srls is not responsible for unforeseeable delays. Saponaro Agricola Srls will send the Customer a confirmation e-mail once the Products have been shipped. In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products will be delivered within 10 (ten) days, except for delays and in any case no later than 30 (thirty) days from the following day. to the one in which the Customer sent the order to Saponaro Agricola Srls

8.5 The times indicated for the delivery of the goods are indicative.

8.6 For the delivery of the goods, the presence of the Customer or his representative must be present at the address indicated in the order. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the delivery document and that the package is intact or not altered. Any damage to the package and / or the Products or the mismatch in the number of packages must be immediately notified by means of a written check on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of the delivered package.

DUTIES AND RESTRICTIONS

9.1 Saponaro Agricola Srls is not responsible for any duties or purchase restrictions applied to the customs of the destination countries.

RIGHT OF WITHDRAWAL

10.1 In execution of the provisions of Legislative Decree 21 February 2014, n.21 implementing Directive 2011/83 / EU on consumer rights, the Customer can return the purchased product and obtain a refund of the purchase amount actually paid, without no penalty and without specifying the reason.

10.2 The right of withdrawal consists in the right to return the purchased products to the seller and consequently obtain a refund of the purchase price of the products themselves.

10.3 The right of withdrawal can be exercised within 14 days of receipt of the product in the following ways:

10.3.1 Before the expiry of the aforementioned term, the Customer sends a registered letter with return receipt to Saponaro Agricola Srls or by presenting another declaration from which the intention to withdraw is explicitly inferred. The communication can be sent, within the aforementioned term, by registered letter to Contrada Amoruso SNC, 72019 San Vito dei Normanni (BR) or by email to the email address: societàagricolacintrone@gmail.com

10.3.2 The customer service of Saponaro Agricola Srls, having verified the conditions for exercising the right of withdrawal, will contact the consumer in order to indicate the place where he must return the intact products, within fourteen days, excluding holidays and weekend, starting from the date of communication of the withdrawal.

10.4 The costs of returning the purchased products are charged to the consumer.

10.5 In the event that the value of the products has undergone a decrease caused by handling other than that necessary to establish the nature, characteristics and functioning of the products, (by way of example: damaged products, not properly or completely packaged, or in which certain parts are missing or have been damaged, such as components, elements, accessories, packaging materials, boxes, documentation and / or other objects), Saponaro Agricola Srls will reimburse the Customer the purchase sum less the value of said decrease.

10.6 In the event that the Customer sends back products beyond the aforementioned deadline or in the case of open and / or partially used products and which do not lend themselves to being returned, the right of withdrawal does not apply and Saponaro Agricola Srls will return to the Customer for the purchased good by charging the shipping costs to the same.

10.7 With the aforementioned limitations, Saponaro Agricola Srls will reimburse the amount actually paid by the Customer within 14 days of receiving the notice of withdrawal, by bank transfer.

DEFECTS OF CONFORMITY, WARRANTY AND REPLACEMENT

11.1 The legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code apply to the sale of products other than food products. To benefit from the guarantee, the customer must keep the invoice, or, where nonexistent, the transport document.

11.3 The Customer has the right to restore, without charge, the conformity of the goods by replacement or to an adequate reduction in the price or to terminate the contract.

11.4 The Customer loses these rights if he does not report the lack of conformity to Saponaro Agricola Srls within two months from the date on which he discovered the defect. The direct action to assert the defects not intentionally concealed by Saponaro Agricola Srls is prescribed, in any case, within twenty-six months from the delivery of the goods.

11.5 If the purchased product has been damaged during transport, the Customer may request its replacement within the deadline of 10 days from receipt.

11.7 The fulfillment of the new order is subject to the availability of the requested Products.

ERRORS

12.1 The information relating to the Products provided on the Site is constantly updated. However, the complete absence of errors cannot be guaranteed.

12.2 Saponaro Agricola Srls reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also to change or update information at any time without prior notice.

APPLICABLE LAW AND JURISDICTION

13.1 These General Conditions are governed by Italian law and must be interpreted in accordance with Italian law.

13.2 For any dispute concerning the General Conditions, the court of the place indicated by the Customer as his residence or domicile will be competent, if located in the territory of the Italian state.
